Welcome to Agu Madeira Baby Gear Rentals (“Agu Madeira”, “we”, “our”, “us”). These Terms and Conditions (“Terms”) govern your use of our website https://www.agumadeira.com and any rental or service provided by us.
By accessing or using our website, or by making a booking, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Nature of Our Service

Agu Madeira provides rental of baby equipment (such as strollers, car seats, cribs, high chairs, and related items) for temporary personal use by visitors and residents in Madeira.
We do not manufacture, design, or certify any baby equipment. All items remain the property of Agu Madeira and are provided strictly on a rental basis.

We clean and sanitize all items before and after each rental, but we do not inspect, test, or certify the mechanical safety or structural integrity of any product.

By renting from Agu Madeira, you acknowledge and accept that:

• Agu Madeira makes no warranties regarding the safety, fitness, or performance of any item;
• All claims related to product defects, safety, or performance must be directed to the manufacturer or producer of the equipment;
• Agu Madeira is not responsible for any accidents, injuries, or damages arising from the use, misuse, or malfunction of rented items.

3. Eligibility

To rent from Agu Madeira, you must:

• Be at least 18 years old;
• Provide accurate identification, contact, and payment details;
• Agree to take full responsibility for the items during the rental period.

4. Rental Terms

a. Booking and Payment

• Bookings may be made online, by email, or via direct contact.
• Full payment (including any delivery, cleaning, or deposit fees) must be made prior to or upon delivery.
• Prices are listed in Euros (€) and include applicable taxes unless otherwise stated.

b. Deposit

• A refundable security deposit may be required for certain items (e.g., car seats, strollers).
• The deposit will be refunded once items are returned in the same condition, subject to inspection.

c. Delivery and Collection

• Delivery and pick-up times will be agreed in advance.
• Customers must be present or ensure someone is available at the specified location.
• Missed appointments may incur additional fees.

d. Use of Equipment

• The customer must use each item in accordance with manufacturer’s instructions and only for its intended purpose.
• Equipment must not be altered, repaired, or disassembled.
• Items must not be lent, sub-leased, or transferred to third parties.
• Customers must keep equipment clean, dry, and secure during the rental period.

5. Responsibility and Liability

a. Customer Responsibility

You are fully responsible for the care, supervision, and safe use of all rented items from the moment of delivery until collection.
If any item is lost, stolen, damaged, or destroyed, you agree to pay the cost of replacement or repair (up to the full retail value).

b. Agu Madeira Disclaimer

Agu Madeira is not the manufacturer of any baby product.
We do not guarantee or verify the safety, design, or suitability of any item.
We only provide cleaning, delivery, and rental logistics.

Accordingly:

• Agu Madeira is not liable for any injury, accident, or damage arising from the use or misuse of any rented product.
• Agu Madeira provides no express or implied warranty, including warranties of merchantability or fitness for a particular purpose.
• All equipment is rented “as is”, and all risk passes to the customer upon delivery.
• Any product defect, malfunction, or safety issue must be addressed directly with the manufacturer or official distributor.

By renting from Agu Madeira, you expressly waive any claim against Agu Madeira, its owners, employees, and contractors for any loss, injury, or damage caused by the use or malfunction of rental equipment.

6. Cleaning and Sanitation

All items are cleaned and sanitized between rentals using child-safe cleaning methods. However:

• Agu Madeira does not certify medical-grade sterilization;
• Minor cosmetic wear, fabric fading, or non-structural imperfections are normal;
• Customers are encouraged to inspect items upon delivery and notify Agu Madeira immediately if they believe an item is unsafe or unsuitable before use.

7. Cancellations and Refunds

• Cancellations made more than 72 hours before the scheduled delivery date will be fully refunded.
• Cancellations made 24–72 hours before delivery will receive a 50% refund.
• Cancellations made less than 24 hours before delivery or after delivery will not be refunded.
• Refunds for early returns are not provided.
• Deposits will be refunded within 5 business days after inspection of returned equipment.

8. Damaged, Lost, or Unreturned Items

• Customers must report any damage or malfunction immediately.
• Lost or damaged items will be charged at replacement cost (current retail value).
• Unreturned items after 7 days of the agreed return date will be considered lost and charged accordingly.

Our website uses cookies to improve your browsing experience and collect analytics data. By using agumadeira.com, you consent to our use of cookies in accordance with our Privacy Policy.

All website content, including text, photos, and logos, is the property of Agu Madeira and may not be reproduced without permission.

11. Limitation of Liability

To the maximum extent permitted by Portuguese law:

• Agu Madeira shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of the use or inability to use the rented products;
• Our total liability under any circumstance shall not exceed the total rental fee paid for the affected item.

Nothing in these Terms shall limit Agu Madeira’s liability for gross negligence, fraud, or intentional misconduct.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Portugal. Any disputes arising in relation to these Terms shall be submitted to the competent courts of Funchal, Madeira.

13. Amendments

Agu Madeira reserves the right to update these Terms at any time without prior notice. The revised version will be posted on this page and will take effect immediately upon publication.
